Ralph Mabey is a Professor of Law at the University of Utah and a shareholder at the firm of
Kirton McConkie. He received his law degree from Columbia University where he served on the
Board of Editors of the Columbia Law Review. He served with distinction as United States
Bankruptcy Judge for the District of Utah before returning to private practice and teaching. His
judicial opinions have been cited frequently by courts and scholars.

Before serving on the faculty at the U, Ralph was a Senior Lecturer at the J. Reuben Clark Law
School, where he taught for 22 years.
 
Ralph is the past International Chair of the J. Reuben Clark Law Society and the founding Chair
of its Salt Lake City Chapter.

He is the past President and Chair of the American College of Bankruptcy. He served as an
appointee of the Chief Justice of the United States to the U.S. Judicial Conference’s Advisory
Committee on the Bankruptcy Rules. He is a member of the American Law Institute, the
National Bankruptcy Conference and a founding member of the International Insolvency
Institute.

In addition to his representation of clients nationwide, courts, parties and the Department of
Justice have appointed Ralph to serve as mediator, arbitrator, examiner or trustee in ten states
and the District of Columbia. He recently served as court-appointed mediator in New York in
the Lehman Brothers cases, the largest bankruptcies ever filed in the U.S. He also served as the
Neutral Evaluator under California law preceding the bankruptcy of the City of Stockton,
California.

Ralph and Sylvia Mabey live in Bountiful. They are the parents of five children and enjoy 16
grandchildren. Ralph and Sylvia last month completed their tenure as Salt Lake Inner City
Missionaries, serving refugees, asylum seekers and others struggling out of the underclass.
Ralph currently serves as a Sealer in the Bountiful Temple.

Richard E. Turley Jr.



Richard E. Turley Jr. is Managing Director of the Public Affairs Department for The Church of Jesus Christ of Latter-day Saints and the author or editor of numerous books and articles on Mormon history topics, including Massacre at Mountain Meadows (New York: Oxford University Press, 2008; with Ronald W. Walker and Glen M. Leonard) and Victims: The LDS Church and the Mark Hofmann Case (Urbana: University of Illinois Press, 1992). He has served on the editorial board for the Joseph Smith Papers project, as coeditor with Brittany Chapman of the Women of Faith in the Latter Days series, and as general editor of the Journals of George Q. Cannon print volumes. He has also served on various boards and committee at Brigham Young University and the University of Utah, as well as in professional and civic organizations.

 

Mr. Turley received a bachelor’s degree in English from Brigham Young University, where he was a Spencer W. Kimball Scholar. He later graduated from the J. Reuben Clark Law School at BYU, where he served as executive editor of the law review and was elected to the Order of the Coif. He also received the Hugh B. Brown Barrister’s Award, presented each year to the graduating student who demonstrates the highest standards of classroom performance. Before dedicating his career to history, he practiced law in the Salt Lake City office of Chapman and Cutler, a Chicago-based law firm.

 

Mr. Turley is the recipient of numerous awards, including the 2017 Genealogy/History Achievement Award from the American Library Association; the 2017 Lifetime Achievement Award from the Conference of Intermountain Archivists; the 2017 Junius F. Wells Award from the Mormon Historic Sites Foundation; the 2015 Honorary Lifetime Member Award from the Utah State Historical Society; the 2013 Herbert Feis Award from the American Historical Association for distinguished contributions to public history; the 2013 Best Anthology Award from the John Whitmer Historical Association; the 2012 Outstanding Achievement Award from the Utah Board of State History; the 2010 Smith-Petitt Foundation Best Documentary Book in Utah History Award; the 2010 Steven F. Christensen Award for Best Documentary Book on Mormon History; the 2009 Best Book Award from the Mormon History Association; a Special Award for History from the Association for Mormon Letters in 2009; the 2008 Co-Founders Best Book Award from Westerners International; and the Historic Preservation Medal from the Daughters of the American Revolution in 2004.

Please join us for this month's luncheon, featuring David Channer, Associate General Counsel of the Church of Jesus Christ of Latter-Day Saints.

David currently serves in the Office of General Counsel for The Church of Jesus Christ of Latter-day Saints. In his service to the Church, he acts as Associate General Counsel – Domestic, with oversight of Church legal matters arising in the United States and Canada.  Prior to this assignment, he served as Regional Legal Counsel with responsibility for international legal matters arising in the following areas of the Church:  Asia, Africa West, Caribbean, Central America, Europe, Europe East, Mexico, Pacific, and South America South.  His areas of responsibility have spanned 22 time zones and involved more than 170 nations. 
 
Prior to accepting his current assignment with the Church, he served in various capacities (e.g., General Counsel, Chief Corporate Counsel, and Associate General Counsel) with several companies in the high tech and international construction, design and engineering industries. He began his legal career in 1985 as an associate with the national law firm of Vinson & Elkins, Houston, TX.
 
David received a B.S. degree from Brigham Young University in 1981, where he graduated magna cum laude.  He received his Juris Doctor degree from Brigham Young University in 1985, where he graduated cum laude.  David served as Articles Editor for the BYU Law Review in 1984-85.
 
He is married to Cindy Green from Mocksville, N.C. and they are the parents of eight children.

Attorneys have special skills, knowledge, and privileges to advocate for the rights of others.  They hold a privileged position in our society.  They can settle disputes, facilitate cooperation, and redeem the rights of the oppressed in ways that non-lawyers cannot.  The talents given to attorneys were not meant to be buried in the earth.  At this year’s pro bono luncheon, we will share stories of attorneys in our community who have multiplied their talents, and we will find inspiration for all of our members to do the same.

Jacey Skinner has served as general counsel for Governor Gary Herbert since 2013. Prior to her appointment, she served as director of the Utah Sentencing Commission since 2008. As director of the commission, Skinner developed and published sentencing guidelines and advised the Legislature, the governor, and the Judicial Council regarding the sentencing and release of juvenile and adult offenders. Ms. Skinner served two terms as the director and president of the National Association of Sentencing Commissions.

Ms. Skinner previously was an assistant district attorney with Salt Lake County. She received a bachelor's degree from Utah State University and a Juris Doctor from the J. Reuben Clark Law School at Brigham Young University.

Join us for our next luncheon featuring Nate Alder and John Lund on the Futures Commission.

Nate and John serve as Co-Chairs of the Commission on the Future of Legal Services in Utah, otherwise known as the "futures Commission" of the Utah State Bar. This Commission published on July 29, 2015 a Report and Recommendations on the Future of Legal Services, with the help of many individuals and representatives of the community, government, bench/court, bar, higher ed and business. Both Nate and John serve on the Task Force of the Utah Supreme Court that is looking at the court/legal profession from the perspective of consumers of legal services and court services.

John Lund is a member of the Utah Judicial Council and the only practicing lawyer on that Council.  He is also an elected Commissioner on the Utah State Bar Commission.  John is a partner at Parsons Behle & Latimer.

Nate Alder is one of Utah's ABA delegates and is active on a national scale with efforts to retool the legal profession and legal education to enable lawyers to succeed in providing lawyers to the full range of clients in our communities. He is also a past president of the Utah Bar.  Nate works at Christensen & Jensen and has been recognized as one of the Top 100 lawyers in the five-state Intermountain West, and one of the Top 25 lawyers in Salt Lake City.

Barbara Melendez chairs the Immigration Law practice group at Richards Brandt. She focuses primarily on family and employment immigration as well as employment immigration compliance matters. Ms. Melendez represents multi-national corporations, educational institutions, religious organizations and employers on all immigration related matters. She is a frequent lecturer on immigration issues. Ms. Melendez graduated from the J. Reuben Clark School of Law at Brigham Young University.
 
Ms. Melendez will present an overview of current immigration issues and policies and the impact of these issues. All are welcome to attend.

Gene Schaerr's Bio:

Gene Schaerr specializes in handling—and usually winning—civil appeals and writ proceedings, both in appellate courts and in the law-focused proceedings at the agency or trial-court level that often determine success or failure on appeal. He has argued and won dozens of cases in a variety of forums—including the U.S. Supreme Court (where he has argued six cases), every federal circuit, and numerous state appellate courts. His win rate in the dozens of federal appeals he has argued in the past seven years is over 75 percent. He was a coordinator of Sidley Austin’s appellate practice from 1993 until 2005, and from 2005 until 2014 was the chair of the appellate practice at Winston & Strawn—a practice he led to numerous recognitions in such publications as the “Appellate Hot List.” His personal practice successes have won him repeated recognition in such publications as Best Lawyers in Washington, D.C., Legal 500, D.C. Superlawyers, and Best Lawyers in America. In January 2014, Mr. Schaerr formed his own sole-practice firm so that he could defend the marriage laws of his home state of Utah and, later, Idaho. He is currently active in defending the marriage laws of Michigan, Ohio, Tennessee and Kentucky before the U.S. Supreme Court.

Substantively, Mr. Schaerr’s experience includes not only virtually every area of federal constitutional law, but also patent and trademark law, product liability and warranty law, environmental law, insurance coverage, class certification, contract law, arbitration, immigration, civil RICO, labor and employment, and tax. He also has particular expertise in religious-freedom litigation and legislation, having handled numerous appeals and legislative matters for major religious bodies as well as religious colleges and universities. In so doing, he has represented either a party or an amicus in virtually every Supreme Court case involving religious freedom for the past 25 years.

Mr. Schaerr began practice in 1987 following clerkships on the U.S. Supreme Court (for Chief Justice Warren Burger and Justice Antonin Scalia) and on the U.S. Court of Appeals for the D.C. Circuit (for then-Judge Kenneth Starr). In his early years of practice he worked closely with former Solicitor General Rex E. Lee on a wide variety of Supreme Court and other appellate matters, as well as several religious-freedom cases and lobbying in favor of the Religious Freedom Restoration Act. He graduated in 1985 from the Yale Law School, where he was Editor-in-Chief of the Yale Journal on Regulation and Senior Editor of the Yale Law Journal. From 1991 to 1993, he served in the White House as Associate Counsel to the President, where he had responsibility for a wide range of constitutional and administrative-law issues, including those involving separation of powers, economic regulation, federalism and religious freedom.

As a writer, Neylan has been published in NewsweekThe Washington Post, Patheos.com, Dialogue: A Journal of Mormon Thought, among others. Neylan drew on hundreds of interviews with women and men and years of studying women's issues in the Church to write Women at Church (Kofford Books, 2014.) Raised in Michigan, Jeff served a mission in the Canada-Montréal mission. Jeff received his law degree from the J. Reuben Clark Law School, where he served as an articles editor for the BYU Law Review. Jeff has practiced law in both California and Utah or more than 25 years. He is currently president and co-owner of Western Architectural Services, a thematic manufacturing company located in Draper, Utah.
 
Jeff is the senior advisor on the editorial board of the Joseph Smith Papers for The Church of Jesus Christ of Latter-day Saints, as well as the manager and coeditor of the Business and Legal Series of the Joseph Smith Papers. He previously served as the associate managing editor for the Papers. He is a trustee and serves on the executive committee as treasurer of the Mormon Historic Sites Foundation, as well as managing editor for Mormon Historic Studies. Jeff has been a part-time professor in the Department of Church History and Doctrine at Brigham Young University and currently is an adjunct professor at the BYU Law School.
 
Jeff has spoken and written widely on Church history, specializing on Joseph Smith’s business and legal affairs. He is often a feature scholar on the KJZZ and History of the Saints television series, at BYU’s Education Week, the Mormon History Association Annual Meetings and history symposiums throughout the country.
 
He is married to the former Elizabeth Hepburn and they have four children, three dogs, two cats, and most importantly eight grandchildren.

The BYU Education Week Continuing Legal Education Program will be held in Provo, Utah, on August 19 – 22, 2014.  This year's program will include presentations on religious liberty issues, trial practice and litigation ethics, adoption, family, and immigration law, legal issues addressed by Oliver Cowdery, and more.  For less than $100.00, attorneys can earn up to 20 CLE credits over the four day program while enjoying the inspirational and information classes offered through both the CLE program and the other Education Week courses.   
 
 An overview of each of the classes offered during this year’s CLE program can be found here. The full class schedule for the entire Education Week program, including the CLE courses, will be posted online on June 20, 2014, at http://ce.byu.edu/edweek/schedule.php
In order to attend the CLE courses, you must register as a Campus Education Week participant. In addition to the Campus Education Week tuition, attorneys seeking Continuing Legal Education credit are required to pay a $35 fee for the week to be paid at the door of 214 Crabtree Building (this covers the state CLE costs). CLE credit verification has already taken place for Utah, but participants seeking credit for all other states must check with their respective state bars for verification that the CLE courses will be accepted for credit.

George Washington's Revoluationary Conception of Conscience

Washington conceptualized the importance of protecting conscience very differently than we do today, as we think primarily in terms of exemptions from general and neutral rules, whereas he viewed conscience as something of deep significance to be treated with "great delicacy and tenderness." This presentation will explore the contemporary relevance of Washington's conception of conscience as it relates to debates concerning the HHS mandate, the treatment of Catholic adoption agencies, and same sex marriage.

Professor Doxey has enjoyed careers in both professional practice and academia. His public service includes serving as chief of staff to Governor Olene S. Walker, general counsel to Governor Michael O. Leavitt, Utah’s deputy commissioner of financial institutions, and associate general counsel to the Utah Legislature. In academia, before his current appointment at the International Center, he was a professor in BYU’s History Department. Professor Doxey has a J.D. from the J. Reuben Clark Law School at BYU and a Ph.D. in history from Cambridge University. In the LDS Church, he has served as a Mission President and currently serves as an Area Seventy.
